Notes from the Ohio Board of Building Standards Meeting:
10:00 a.m. Friday, January 27th, 2012 in Reynoldsburg.
Under New Business:
- The set-agenda was altered slightly to permit Ohio Dept. of Commerce Director., David Goodman, the opportunity to speak first. Mr. Goodman addressed the proposed Amendments to the Ohio Building Code § 102.11 and Chapter 2. The focus and scope of his request for an emergency rule adoption by the BBS relates to the Utica Shale exploration and drilling site activities beginning to appear in northeast Ohio. He stated the immediate need to identify these specific types of “Gas and Oil production” projects along with their usages of structures/buildings. After a brief Q & A period, the board voted to approve an emergency passage of the Directors’ proposed amendments. The temporary emergency approval will allow the board 90 days to formulate permanent code language of sufficient clarity for the Joint Committee on Agency Rule Review (JCARR).
Residential Code of Ohio
update:
- Mark Hamilton from Lt. Governor Mary Taylor’s office spoke to the board regarding the requirement for every new government rule to be subjected to a Business Impact Analysis. This requirement reinforces JACARR’s authority to strike any language it determines in opposition to any existing rules.
- The spokesman for the Residential Code Advisory Committee (RCAC) followed Mr. Hamilton and explained to board members that the 2009 RCO adoption process had already been evaluated by JACARR. They moved and approved the adoption of the 2009 RCO with an effective date of January 1st, 2013.
Under Old Business: The board considered and acted on the following:
- Action on Amendments Group LXXXV (85) – Elevator Code and Plumbing Code; Approved.
- David A. Smith Building Department Award – Wood County was approved for the award.
- Christopher Wilson Report & Recommendation – Requestor was appealing to the board regarding the board’s Certification Committees recommended denial of his application for Interim Building Official status. Chairman Gerald Holland was helpful in explaining the guidelines used to evaluate each application. After some discussion, the board voted to uphold the committee’s recommendation for denial.
- Request for Hearings / John Stigalt – matter was assigned to a Hearing Officer.
Returning to New Business:
- Complaints and Investigations – Mr. Carl Kardy has appealed to the 9th District Court of Appeals per Attorney General’s Office.
- Petition #1104 (Electrical Safety Inspector Certification Requirements) – sent to Certification Committee.
- Electrical Safety Inspector Advisory Committee Appointment – Sam Cronk (Marysville)
